A HUMANISTIC GOVERNMENT THAT SERVES ALL OF GUANAJUATO´S CITIZENS

 

PRESENTATION

The fifth commitment sets out our obligation to guarantee that public administration ensures the conditions needed to allow a state of governability. Therefore, we guarantee an unyielding respect for individual and communal guarantees within a framework of democracy, freedom, legality, truth, justice, peace, and equal opportunity. Our government will be humanistic, inclusive, participative and efficient: it will be a government in which solidarity, subsidiarity, collaboration between society and the various levels and powers of government are the order of the day, so as to thereby guarantee the development of our state and its people.

CURRENT SITUATION

INFORMATION

It is necessary to inform the public of the services and procedures offered by the state government. It is therefore important to improve the means by which this kind of information reaches people.

HONESTY AND TRANSPARENCY

In an attempt to generate responsibility, and in response to the public demand for accountability and clarity in the presentation of results and objectives, the Government of the State of Guanajuato has established thorough policies to reinforce all our efforts and to guarantee honesty and transparency in the use of resources, amongst them:

• Requiring public servants to make a declaration of their personal wealth.

• The publication of state financial statements in the media across the state.

• The strengthening of the figure of comptroller and the creation of a social comptroller´s office.

• The annual government report through which the population of the state aris made aware of the state of public administration.


Recently, work has begun on looking at the possibility of creating an Órgano Superior de Fiscalización in the state, the office which would be responsible for monitoring how resources are allocated and used, and the progress of goals set by the three levels of government and municipal authorities.

Similarly, we shall investigate the need for an administrative ombudsman, who would issue recommendations regarding administrative control.

PUBLIC PARTICIPATION

In the area of democratic planning, the level of coordination and liaison between institutions must be reinforced in order to ensure that the planning takes place within the framework of current norms and perspectives.


Public involvement has been boosted thanks to the Municipal Development Planning Councils (COPLADEM) at a municipal level and the Guanajuato State Development Planning Council (COPLADEG) at the state level, bearing in mind the importance of strengthening public participation within the new legal framework as regards planning.

THE QUALITY OF PUBLIC SERVICES

Recent opinion polls have given us an idea of the public’s perception of the services provided by the state government. Graph 12 shows how various government services were judged (where 1 = the lowest score, 10 = the highest score). The results also indicate where there is room for improvement in the quality of public services.

STATE GOVERNMENT INCOME AND EXPENDITURE

Income and the way in which budget resources are channeled are the main elements of public finances.


In terms of income, there is an undeniable dependence on Federal Government funds. Such funds accounted for 92% of total income for 199966, (41% for specific purposes, 51% non-specific). Own income therefore (taxes, duties, user fees and part of public services tax income) accounts for a small proportion of the public spending budget, leaving the state government little room for maneuver in its ability to allocate resources for its priorities.


State gross domestic product (GDP) has shown a constant annual growth in nominal terms, and the increase in public spending has reached high figures, primarily due to greater federal funding allocation. In 1999, the state budget made up 9.15% of state GDP67.


Regarding financing through public debt, the proportion of the state spending budget financed by state debt has been reduced; the stability and soundness of state finances have enabled credit and investment capacity to improve, along with the state’s ability to meet its financial commitments on time.

THE DEVELOPMENT OF PUBLIC ADMINISTRATION

In recent years, state public administration has begun a number of projects aimed at bringing about the modernization of public administration in order to make work processes more efficient. To do this, it has employed total quality, constant improvement and process reengineering techniques. This process now needs to combine these efforts in a program that takes into account a range of aspects, such as: organic structures, interinstitutional work processes, performance evaluation, the training of public servants, standardized planning techniques, and so on.


It is necessary to establish the civil service as a career, furthermore, one which has clear criteria concerning the selection, promotion, permanence of public servants, and the benefits available to them, in order to encourage continuity in the sector.

COORDINATION BETWEEN THE THREE LEVELS OF GOVERNMENT

Regarding the coordination between federal and state governments, there have been a number of agreements reached which guarantee the transfer of a range of functions and services, whilst ensuring total respect for the sovereignty of the state from the federal government.

Similarly, there are a range of mechanisms in place which coordinate activities between state and municipal authorities, whilst guaranteeing the autonomy of the latter.


Coordination between the Judicial Power and the Legislative Power must be reinforced in order to guarantee their legality and absolute respect for their faculties
.

Similarly, there is clear support for the move towards municipalization, for which reason greater resources and contributions have been assigned to the municipalities in strict accordance with Article 115 of the Mexican Constitution.


As for contributions, policies and regulations have been established to ensure that these are transferred to municipalities in an ordered and transparent fashion, using fair-minded criteria in the formula to be used in allocating resources, a formula established by the state government administration.


An evaluation of the progress of the municipalization process indicated the following needs:


• To strengthen the full exercise of the municipalities’ allocated duties and responsibilities.

• To ensure that the services for which they are responsible are provided appropriately.

• To design a mechanism to monitor administrative and financial transfers.

RESPECT FOR HUMAN RIGHTS

Another function of the state government is to guarantee social peace and respect for human rights. To do this, there needs to be a strengthening of the mechanisms used to detect and promptly deal with public demands and safeguard individual and social guarantees.
